DMCA Policy

devilfruit wiki ("devilfruit wiki," "we," "us," or "our") respects the intellectual property rights of others and expects Users ("Users," "you") to do the same. It is devilfruit wiki's policy, in appropriate circumstances and at our sole discretion, to remove or disable access to material that allegedly infringes the copyrights of others pursuant to the Digital Millennium Copyright Act (17 U.S.C. §512) ("DMCA") and to terminate repeat infringers.

1. Designated Copyright Agent

2. DMCA Takedown Notices

If you believe that content on or through the Service infringes your copyright, you may submit a written DMCA Notice to the Designated Agent that includes all elements required under 17 U.S.C. §512(c)(3).

Your DMCA Notice MUST include:

• A physical or electronic signature of the copyright owner or person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
• Identification of the material that is claimed to be infringing or the subject of infringing activity, with sufficient detail to enable devilfruit wiki to locate it.
• Contact information for the complaining party, including name, address, telephone number, and email address.
• A statement that the complaining party has a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the Notice is accurate and, under penalty of perjury, that the complaining party is the owner or authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed.

Failure to include all required information may render your Notice invalid or result in delayed processing.

3. Removal of Allegedly Infringing Material

Upon receiving a valid DMCA Notice, devilfruit wiki may:

• Remove or disable access to the allegedly infringing material;
• Notify the User responsible for the material;
• Request additional information from either party;
• Suspend or terminate User accounts implicated in repeated infringement;
• Take any other action devilfruit wiki deems appropriate at its sole discretion.

devilfruit wiki is not required to adjudicate ownership disputes and may remove content without determining whether infringement occurred.

4. Counter-Notification Procedure

If your material was removed or disabled due to a DMCA Notice, and you believe the removal was incorrect or that you are lawfully entitled to use the material, you may submit a Counter-Notification to the Designated Agent.

Your Counter-Notification must include:

• Your physical or electronic signature.
• Identification of the material removed or disabled, and the location at which it previously appeared.
• A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district where your address is located (or the Central District of California if outside the U.S.), and that you will accept service of process from the original complaining party.

Important Notes:

• Filing a Counter-Notification may result in legal action between you and the complaining party.
• devilfruit wiki may restore the material only if the complaining party does not file an action seeking a court order within the required statutory period.
• devilfruit wiki reserves the right to decline restoring any material for any reason.

5. Repeat Infringer Policy

devilfruit wiki may, in appropriate circumstances and at its sole discretion:

• Disable or terminate accounts of Users deemed repeat infringers;
• Permanently ban Users who repeatedly upload infringing content;
• Deny future access to the Service.

devilfruit wiki's definition of "repeat infringer" may differ from legal standards and may consider multiple factors, including the number, frequency, and severity of DMCA notices associated with a User.

6. Misrepresentations & Abuse of Process

Under 17 U.S.C. §512(f), knowingly misrepresenting that material is infringing (or was removed in error) may subject you to legal liability, including damages, costs, and attorneys' fees.

devilfruit wiki may restrict or ban individuals who misuse the DMCA process, including submitting fraudulent, harassing, or bad-faith notices.

7. No Legal Advice; Right to Modify

Nothing in this Policy constitutes legal advice. devilfruit wiki may update or modify this Policy at any time without prior notice. Updates will be posted at https://wiki.devilfruit.com.
